A resolution to put away violently malicious criminals.

WHEREAS Washington State Senator Joseph Zarelli had introduced a bill into the State Senate on January 13, 2002, and

WHEREAS the bill asserts to reaffirm the 1975 finding that any felony, including assault, can be a predicate offense for felony murder, and

WHEREAS a predicate offense can have unintended consequences, and

WHEREAS the bill states the legislature does not agree with or accept the State courtās findings of the legislative intent in Washington State v. Andress, Dockett No. 71170-4 (October 24, 2002), and,

WHEREAS the bill reasserts that assault has always been and still remains a predicate offense for felony murder in the second degree, and

WHEREAS the Senate Bill 5001 has been referred to the Senate Judiciary Committee on January 13, 2003.

BE IT RESOLVED BY THE ASSOCIATED STUDENTS OF THE UNIVERSITY OF WASHINGTON:

THAT the ASUW does formally support the Washington State legislature in its attempt and originally intent to prosecute assault with unintended consequences as felony murder in the second degree, and

THAT the ASUW does formally support Washington State Senate Bill 5001
